ตามประกาศกระทรวงอุตสาหกรรม ได้ระบุว่า “กากอุตสาหกรรม” คือ “สิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้ว” หรือหมายถึง ของเสียหรือสิ่งที่ไม่ใช้แล้วที่เกิดจากการประกอบกิจการโรงงาน ตั้งแต่กระบวนการรับวัตถุดิบ การผลิต การตรวจสอบคุณภาพ การบำบัดมลพิษ การซ่อมบำรุงเครื่องจักรหรืออุปกรณ์ ไปจนถึงการรื้อถอนหรือก่อนสร้างอาคารภายในบริเวณโรงงาน กากตะกอน หรือสิ่งตกค้างจากสิ่งเหล่านั้น ทั้งที่อยู่ในสภาวะของแข็ง ของเหลว กึ่งแข็ง กึ่งเหลวหรือก๊าซ รวมถึงของเสียอันตรายที่เกิดจากอาคารสำนักงานและที่พักคนงานที่อยู่ภายในบริเวณโรงงาน

ประเภทของกากอุตสาหกรรม

กากอุตสาหกรรมที่เกิดขึ้นในกระบวนการผลิตทางอุตสาหกรรมหรือสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้ว แบ่งเป็น 2 ประเภทหลัก คือ
1. กากอุตสาหกรรมที่ไม่เป็นอันตราย (Non - Hazardous waste) หมายถึง ของเสียหรือกากอุตสาหกรรมที่ไม่ก่อให้เกิดผลกระทบต่อสิ่งแวดล้อม เช่น ชานอ้อย เศษทองแดง ขี้เลื่อย กล่องกระดาษ เศษกระดาษ เป็นต้น กากอุตสาหกรรมประเภทนี้จะไม่เป็นอันตราย แต่หากไม่ได้รับการจัดการอย่างถูกต้อง อาจมีโอกาสส่งผลเสียต่อสิ่งมีชีวิต ระบบนิเวศและสิ่งแวดล้อมได้ โรงงานอุตสาหกรรมส่วนใหญ่จะส่งกากอุตสาหกรรมที่ไม่เป็นอันตรายไปรีไซเคิล โดยวิธีการคัดแยกเพื่อจำหน่ายต่อหรือการปรับปรุงคุณภาพของวัสดุที่ใช้แล้วให้กลับมามีคุณภาพดังเดิมและนำไปใช้ประโยชน์ใหม่อีกครั้ง
2. กากอุตสาหกรรมที่เป็นอันตราย (Hazardous waste) หมายถึง กากอุตสาหกรรมที่มีองค์ประกอบหรือปนเปื้อนสารอันตราย หรือมีคุณสมบัติที่เป็นอันตราย ตามที่กำหนดในภาคผนวกที่ ๒ ท้ายประกาศกระทรวงอุตสาหกรรม เรื่อง การกำจัดสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้ว พ.ศ. ๒๕๔๘ ยกเว้นสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้วหรือกากอุตสาหกรรม ที่ไม่เป็นอันตรายจากสำนักงาน บ้านพักอาศัย และโรงอาหารในบริเวณโรงงาน กากกัมมันตรังสี และมูลฝอยตามพระราชบัญญัติการสาธารณสุข พ.ศ. ๒๕๓๕ และรวมถึงน้ำเสียที่ส่งไปบำบัดนอกโรงงานทางท่อส่งน้ำ โดยสามารถจัดกลุ่มเป็นประเภทต่าง ๆ ดังนี้

  • ประเภทสารไวไฟ (Ignitable substances)
  • ประเภทสารกัดกร่อน (Corrosive substances)
  • ประเภทสารที่เกิดปฏิกิริยาได้ง่าย (Reactive substances)
  • ประเภทสารพิษ (Toxic substances)
  • สารที่มีองค์ประกอบของสิ่งเจือปนที่เป็นอันตรายตามประกาศของกระทรวงอุตสาหกรรม เช่น นิเกิล แคดเมียม อุปกรณ์ที่มีปรอท เป็นต้น

บทบาทหน้าที่ของผู้ประกอบการที่เกี่ยวข้องในการกำจัดกากอุตสาหกรรม

การบริหารจัดการกากอุตสาหกรรม จำเป็นต้องใช้กฎหมายในการกำกับดูแลอย่างเข้มงวด และต้องมีการจัดการอย่างถูกต้องและเหมาะสมตามหลักวิทยาศาสตร์ เพื่อป้องกันไม่ให้ส่งผลกระทบกับชุมชนและสิ่งแวดล้อมในวงกว้าง โดยผู้ที่มีส่วนเกี่ยวข้องในการจัดการกากอุตสาหกรรมมี 3 กลุ่มใหญ่ ซึ่งแต่ละกลุ่มมีหน้าที่ความรับผิดชอบ เพื่อให้การดำเนินการจัดการกากอุตสาหกรรมเป็นไปอย่างถูกต้องไม่ก่อให้เกิดผลกระทบต่อสุขอนามัย ความปลอดภัยของประชาชน และลดผลกระทบต่อสิ่งแวดล้อม ประกอบด้วย
1. โรงงานผู้ก่อกำเนิดกากอุตสาหกรรม (Waste Generator–WG) เมื่อมีกากอุตสาหกรรมเกิดขึ้น โรงงานมีหน้าที่ในการจัดการให้ถูกต้องตามกฎหมาย โดยตรวจสอบปริมาณ ประเภท และวิธีการกำจัดหรือบำบัด และต้องรายงานการจัดการกากอุตสาหกรรมเหล่านั้นด้วย โดยต้องไปขออนุญาตบำบัดหรือกำจัดจากกรมโรงงานอุตสาหกรรม
2. ผู้ขนส่งกากอุตสาหกรรม (Waste Transporter–WT) ในการบำบัดหรือกำจัดนั้น โรงงานผู้ก่อกำเนิดกากอุตสาหกรรมจะดำเนินการเองหรือส่งให้ผู้อื่นจัดการแทนก็ได้ หากส่งให้ผู้อื่นบำบัดหรือกำจัดจะต้องมีการขนส่งกากอุตสาหกรรมออกจากโรงงานผู้ก่อกำเนิดฯ (WG) ซึ่งผู้ขนส่งกากอุตสาหกรรม (WT) จะต้องได้รับการขึ้นทะเบียนอย่างถูกต้องและได้มาตรฐาน พร้อมกรอกข้อมูลในเอกสารกำกับการขนส่งของเสียอันตราย หรือเอกสารแสดงการจัดการ (Manifest Form / แบบ กอ.2) ทุกครั้ง เพื่อให้แน่ใจว่าการขนส่งกากอุตสาหกรรมอันตรายจะไม่เกิดการรั่วไหลในระหว่างขนส่ง
3. โรงงานผู้รับบำบัดกำจัดกากอุตสาหกรรม (Waste Processor–WP) หรือโรงงานอุตสาหกรรมที่ขึ้นทะเบียนโรงงานลําดับประเภทที่ 101, 105 และ 106 ตามบัญชีประเภทของโรงงานอุตสาหกรรมที่จําแนกตามกฎกระทรวงตามความในพระราชบัญญัติโรงงาน ซึ่งมีลักษณะกิจการจำแนกตามลําดับประเภท ดังนี้
3.1 ประเภทหรือชนิดโรงงานลักษณะที่ 101 โรงงานปรับคุณภาพของเสียโดยรวม (Central Waste Treatment) ลักษณะกิจการที่ดำเนินการ คือ

  • โรงงานบำบัดน้ำเสียรวมสำหรับน้ำเสียจากโรงงานอุตสาหกรรม : เป็นการบำบัดมวลสารที่มีอยู่ในน้ำเสียและนำกากตะกอนไปกำจัดอย่างถูกวิธีต่อไป
  • โรงงานเผากากของเสียรวม (เตาเผาของเสียที่ไม่เป็นของเสียอันตราย/เตาเผาเฉพาะ/เตาเผาร่วม) : เป็นการบำบัดของเสียโดยการใช้ความร้อนเพื่อทำลายมลพิษ และลดความเป็นอันตรายของสารบางอย่าง โดยมีระบบบำบัดมลพิษอากาศและจัดการเถ้าที่เกิดขึ้นอย่างถูกต้อง โรงงานปรับเสถียรกากของเสียที่เป็นอันตรายจากโรงงานอุตสาหกรรม : เป็นการเปลี่ยนสภาพกากของเสียอันตรายให้มีความเป็นอันตรายหรือเป็นพิษน้อยลงด้วยวิธีปรับสภาพความเป็นกรดด่างของกากของเสียให้มีค่าเป็นกลาง และทำให้เป็นของแข็งโดยผสมกับปูนซีเมนต์ เพื่อห่อหุ้มกากของเสีย ป้องกันการชะล้าง เพื่อให้กากของเสียอยู่ในสภาพคงตัวก่อนนำไปฝังกลบอย่างปลอดภัย

3.2 ประเภทหรือชนิดโรงงานลักษณะที่ 105 เป็นโรงงานประกอบกิจการเกี่ยวกับการคัดแยกหรือฝังกลบสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้ว ลักษณะกิจการที่ดำเนินการ คือ

  • โรงงานคัดแยกกากของเสีย : เป็นการแบ่งแยกกากของเสียโดยกากของเสียที่สามารถใช้ประโยชน์ได้อีกจะถูกส่งไปยังโรงงานต่าง ๆ เพื่อนำกลับมาใช้ประโยชน์อีก และจัดการส่วนที่เหลือจากการคัดแยกอย่างถูกต้องต่อไป
  • โรงงานฝังกลบกากของเสีย : เป็นการนำกากของเสียไปฝังกลบในหลุมฝังกลบ ซึ่งแบ่งออกเป็น 2 ประเภท ได้แก่ หลุมฝังกลบตามหลักสุขาภิบาล (Sanitary Landfill) และหลุมฝังกลบอย่างปลอดภัย (Secure Landfill)

3.3 ประเภทหรือชนิดโรงงาน ลักษณะกิจการที่ 106 เป็นการนำผลิตภัณฑ์อุตสาหกรรมที่ไม่ใช้งานแล้ว หรือของเสียจากโรงงานมาผลิตเป็นวัตถุดิบหรือผลิตภัณฑ์ใหม่ โดยผ่านกรรมวิธีการผลิตทางอุตสาหกรรม ลักษณะของโรงงานเป็นการนําผลิตภัณฑ์อุตสาหกรรมที่ไม่ใช้แล้วหรือของเสียจากโรงงานมาผลิตเป็นวัตถุดิบ หรือผลิตภัณฑ์ใหม่โดยผ่านกรรมวิธีการผลิตทางอุตสาหกรรม ลักษณะกิจการที่ดำเนินการ คือ เป็นการนำผลิตภัณฑ์อุตสาหกรรมที่ไม่ใช้แล้วหรือของเสียจากโรงงาน มาผลิตเป็นวัตถุดิบหรือผลิตภัณฑ์ใหม่โดยผ่านกรรมวิธีการผลิตทางอุตสาหกรรม เช่น

  • การตาก การอบ หรือการขจัดความชื้นจากของเสียอุตสาหกรรมการเกษตร
  • การบดหรือการล้างผลิตภัณฑ์แก้ว
  • การบดย่อยคอนกรีต อิฐ กระเบื้อง และเซรามิก (Demolition Waste) ให้เป็นมวลหยาบหรือมวลละเอียด (Coarse and Fine Aggregates)
  • การบดย่อยตะกรันจากการหลอมหล่อโลหะ
  • การทำสารปรับปรุงคุณภาพดินจากกากตะกอนระบบบำบัดน้ำเสียแบบชีวภาพ
  • การทำสารปรับปรุงคุณภาพดินจากสารอนินทรีย์ที่ไม่เป็นของเสียอันตราย
  • การกรองหรือการแยกสิ่งปนเปื้อนจากน้ำมันพืชที่ไม่ใช้แล้ว เพื่อใช้เป็นวัตถุดิบสำหรับอุตสาหกรรมอื่น
  • การผลิตเชื้อเพลิงชีวภาพ (ไบโอดีเซล) จากน้ำมันพืชหรือน้ำมันสัตว์ที่ไม่ใช้แล้วหรือจากของเสียอุตสาหกรรมการเกษตร
  • การผลิตเชื้อเพลิงชีวภาพ (ไบโอเอทานอล) จากของเสียอุตสาหกรรมการเกษตร
  • การผลิตเชื้อเพลิงชีวภาพ (ไบโอก๊าซ) จากการย่อยสลายกากตะกอนชีวภาพหรือจากของเสียอุตสาหกรรมการเกษตรในถังปฏิกิริยา (Sludge Digester)

การเลือกผู้รับบำบัดกำจัดกากอุตสาหกรรม (Waste Processor) ที่ได้มาตรฐาน

ทั้งนี้ สิ่งสำคัญคือ โรงงานผู้ก่อกำเนินกากอุตสาหกรรมจำเป็นต้องเลือกผู้รับบำบัดกำจัดกากอุตสาหกรรมที่น่าเชื่อถือและมีระบบการจัดการที่ได้มาตรฐาน อาทิเช่น โรงงานที่ได้รับตราสัญลักษณ์มาตรฐานโรงงานจัดการกากอตสาหกรรมของกรมโรงงานอุตสาหกรรม โรงงานที่ได้รับรองอุตสาหกรรมสีเขียว อย่างน้อยระดับ 3 ของกระทรวงอุตสาหกรรม โรงงานที่ได้รับรองมาตรฐานโรงงานอุตสาหกรรมเชิงนิเวศ สำหรับผู้ประกอบการจัดการของเสีย (Eco Factory for Waste Processor) ของการนิคมอุตสาหกรรมแห่งประเทศไท ร่วมกับสภาอุตสาหกรรมแห่งประเทศไทย หรือโรงงานผู้รับบำบัดกำจัดกากอุตสาหกรรมที่มีระบบการจัดการ เทคโนโลยีที่มั่นใจได้ว่ากากอุตสาหกรรมถูกนำไปจัดการอย่างเหมาะสม ตามลักษณะกากอุตสาหกรรมที่เกิดขึ้น เป็นต้น และผู้รับบำบัดกำจัดกากอุตสาหกรรมมีการดำเนินกิจการถูกต้องตามกฎหมายอีกด้วย

เนื่องจาก “ประกาศกระทรวงอุตสาหกรรม เรื่อง การจัดการสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้ว พ.ศ. 2566” ที่นำหลักการผู้ก่อมลพิษเป็นผู้จ่ายหรือเป็นผู้รับผิดชอบ (Polluter Pays Principle: PPP) มาใช้อย่างเต็มรูปแบบ กำหนดความรับผิดชอบตั้งแต่ต้นทางโรงงานผู้ก่อกำเนิด ไปจนกว่าสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้วจะได้รับการจัดการจนแล้วเสร็จ ดังนั้น โรงงานผู้ก่อกำเนิดจึงต้องตรวจสอบให้ถี่ถ้วนก่อนจะเลือกใช้บริการ

What is industrial waste or industrial by-products?

According to the announcement of the Ministry of Industry, "industrial waste" is defined as "waste or materials that are no longer in use" or refers to waste or materials generated from the operation of a factory, starting from the raw material receiving process, production, quality inspection, pollution control, maintenance of machinery or equipment, to the dismantling or construction of buildings within the factory premises. This includes sludge or residue from those processes, whether in solid, liquid, semi-solid, semi-liquid, or gas form, as well as hazardous waste generated from office buildings and worker accommodations located within the factory area.

Types of Industrial Waste

Industrial waste generated in the industrial production process or waste or materials that are no longer in use are divided into two main categories:
1. Non-hazardous Industrial Waste: This refers to waste or industrial by-products that do not pose a threat to the environment, such as bagasse, copper scraps, sawdust, paper boxes, and paper scraps. This type of industrial waste is not hazardous; however, if not managed properly, it may still have a negative impact on living organisms, ecosystems, and the environment. Most industrial factories will recycle non-hazardous industrial waste through methods of sorting for resale or by restoring the quality of used materials to their original standard for further reuse.
2. Hazardous Industrial Waste: This refers to industrial waste that contains hazardous substances or characteristics as specified in Appendix 2 of the Ministry of Industry's announcement regarding the disposal of waste or materials that are no longer in use, B.E. 2548 (2005), except for waste or materials that are non-hazardous from offices, residences, and canteens within the factory. This includes radioactive waste and garbage as per the Public Health Act, B.E. 2535 (1992), and includes wastewater sent for treatment outside the factory through pipelines. These can be classified into the following categories:

  • Flammable substances (Ignitable substances)
  • Corrosive substances (Corrosive substances)
  • Reactive substances (Reactive substances)
  • Toxic substances (Toxic substances)
  • Substances containing hazardous contaminants as per Ministry of Industry announcements, such as nickel, cadmium, and mercury-containing devices, etc.

The Role of Operators Involved in Industrial Waste Disposal

Management of industrial waste requires strict adherence to laws and must be conducted properly and appropriately according to scientific principles to prevent negative impacts on communities and the environment at large. The parties involved in managing industrial waste consist of three main groups, each with specific responsibilities to ensure that industrial waste management is carried out correctly, does not endanger public health and safety, and minimizes environmental impact, which includes:
1. Waste Generator–WG: When industrial waste is generated, the factory is responsible for managing it in compliance with the law by checking the quantity, type, and method of disposal or treatment, and must report the management of such industrial waste. They must also obtain permission for treatment or disposal from the Department of Industrial Works.
2. Waste Transporter–WT: In the treatment or disposal process, the waste generator can carry out the disposal themselves or allow others to manage it on their behalf. If they send it to others for disposal or treatment, the industrial waste must be transported out of the waste generator's facility (WG), and the waste transporter (WT) must be properly registered and comply with standards, filling out the hazardous waste transport documentation or treatment management documents (Manifest Form) every time, to ensure that hazardous industrial waste does not leak during transport.
3. Waste Processor–WP: This refers to an industrial facility registered under types 101, 105, and 106 per the industrial factory classification regulations, which is categorized as follows:
3.1 Type 101 Facility for Central Waste Treatment: The operation of this type includes:

  • Central wastewater treatment plants for wastewater from industrial factories: This involves treating the substances present in the wastewater and disposing of the sludge properly.
  • Incineration plants for hazardous waste (non-hazardous waste incinerators/specific incinerators/co-incinerators): This uses heat to destroy pollutants and reduce the hazardous nature of certain substances while legally managing air pollution control and ash generated properly. Facilities that stabilize hazardous industrial waste convert hazardous waste into a less harmful or toxic state by neutralizing the acid and base properties of the waste and solidifying it by mixing with cement to encapsulate it, preventing leaching, to maintain stability before safe disposal in landfills.

3.2 Type 105 Facilities involve sorting or landfilling waste or materials that are no longer in use. Their operations are as follows:

  • Waste sorting facilities: These separate waste material that can be reused from those that cannot, ensuring that reusable waste is sent to other facilities for repurposing while managing the remaining waste properly.
  • Waste landfilling facilities: These dispose of waste in landfills, categorized into sanitary landfills and secure landfills.

3.3 Type 106 facilities involve the process of transforming unused industrial products or factory waste into new raw materials or products, using industrial manufacturing processes. Their operations include:

  • Drying, baking, or removing moisture from agricultural waste.
  • Crushing or washing glass products.
  • Crushing concrete, bricks, tiles, and ceramic demolition waste into coarse and fine aggregates.
  • Crushing slag from metal smelting.
  • Creating soil amendments from effluent sludge from biological wastewater treatment systems.
  • Producing soil amendments from non-hazardous inorganic materials.
  • Filtering or separating contaminants from used vegetable oil to be utilized as raw materials in other industries.
  • Producing biofuels (biodiesel) from used vegetable or animal fats or from agricultural industrial waste.
  • Producing biofuels (bioethanol) from agricultural industrial waste.
  • Producing biofuels (biogas) from the anaerobic digestion of biological sludge or from agricultural industrial waste in digesters.

Selecting a Standardized Waste Processor

It is crucial for waste-generating factories to choose reputable and standardized waste processors, such as those that have been awarded the industrial waste management certification from the Department of Industrial Works, or those achieving at least level 3 certification in the Green Industry from the Ministry of Industry, or those certified as Eco Factories for Waste Processors by the Industrial Estate Authority of Thailand in cooperation with the FTI, or specialized waste processing facilities that ensure proper management of industrial waste in accordance with its nature, etc. Additionally, the waste disposal facilities must operate legally.

According to the "Announcement of the Ministry of Industry on Managing Waste or Materials No Longer in Use, B.E. 2566 (2023)" which fully implements the Polluter Pays Principle (PPP), the responsibilities start from the source, the waste-generating factory, until the waste or materials are fully managed. Therefore, waste-generating factories must conduct thorough reviews before choosing service providers.
