ทุกวันนี้คำที่เราคุ้นชินและพูดบ่อยมากคือ “ลิขสิทธิ์” “สิทธิบัตร” “เครื่องหมายการค้า” “ความลับทางการค้า” “ชื่อทางการค้า” หรือหลายครั้งถูกเหมาเรียกรวมว่า “ลิขสิทธิ์” ก็มี แต่รู้หรือไม่ว่า เหล่านี้ล้วนเป็นส่วนหนึ่งของประเภท “ทรัพย์สินทางปัญญา” ซึ่งหมายถึง ผลงานที่เกิดจากการคิดค้น สร้างสรรค์ และประดิษฐ์ขึ้นมาใหม่จากสติปัญญาของเรา รวมแม้กระทั่งแนวความคิดด้วย

ปัจจุบันปัญหาการละเมิดทรัพย์สินทางปัญญายังคงเป็นปัญหาที่เกิดขึ้นอย่างต่อเนื่อง ทั้งในรูปแบบสินค้าละเมิดลิขสิทธิ์ และสินค้าเลียนแบบ หรือสินค้าก๊อบปี้ ยิ่งเมื่อสินค้าขายดีและมีชื่อเสียงขึ้นมา การถูกละเมิดทรัพย์สินทางปัญญาย่อมเกิดขึ้นแน่นอน ซึ่งสร้างความเสียหายให้กับธุรกิจและผลกระทบต่อมูลค่าทางเศรษฐกิจของประเทศ

ผู้อ่านเชื่อหรือไม่ว่า ในแต่ละเดือนและปี มีคดีการละเมิดทรัพย์สินทางปัญญาอยู่ไม่น้อย ซึ่งกรมทรัพย์สินทางปัญญาได้เปิดเผยสถิติการปราบปรามการละเมิดทรัพย์สินทางปัญญาในประเทศไทยอย่างมีนัยสำคัญ โดยมีการเปรียบเทียบข้อมูลระหว่างปี 2565 และ 2566 ตั้งแต่มกราคม-กันยายน ของสำนักงานตำรวจแห่งชาติ กรมสอบสวนคดีพิเศษ และกรมศุลกากร ทั้งในรูปแบบคดีและของกลาง ดังตารางด้านล่างนี้
ประเภททรัพย์สินทางปัญญา (Intellectual Property)
เพื่อเป็นการปกป้องนวัตกรรมและรับมือไม่ให้ธุรกิจได้รับผลกระทบจากการถูกละเมิดหรือละเมิดทรัพย์สินทางปัญญาผู้อื่น ก่อนอื่นผู้ประกอบการ นักธุรกิจ หรือแม้แต่สตาร์ตอัปต้องรู้ว่าทรัพย์สินทางปัญญามีกี่ประเภท และคุ้มครองอะไรบ้าง ขอสรุปให้ทราบ ดังนี้
ทรัพย์สินทางปัญญา แบ่งออกเป็น 2 ประเภท ได้แก่
1. ลิขสิทธิ์ (Copyright) หมายถึง สิทธิแต่เพียงผู้เดียวที่จะกระทำการใด ๆ เกี่ยวกับงานที่ผู้สร้างสรรค์ได้ริเริ่มโดยการใช้สติปัญญาความรู้ ความสามารถ และความวิริยะอุตสาหะของตนเองในการสร้างสรรค์ โดยไม่ลอกเลียนงานของผู้อื่น โดยงานที่สร้างสรรค์ต้องเป็นงานตามประเภทที่กฎหมายลิขสิทธิ์ให้คุ้มครอง โดยผู้สร้างสรรค์จะได้รับความคุ้มครองทันทีที่สร้างสรรค์โดยไม่ต้องจดทะเบียน
งานที่กฎหมายลิขสิทธิ์ให้ความคุ้มครองแก่งานสร้างสรรค์มีด้วยกัน 9 ประเภท ตามที่กฎหมายกำหนด ได้แก่
งานวรรณกรรม เช่น หนังสือ จุลสาร สิ่งพิมพ์ คำปราศรัย โปรแกรมคอมพิวเตอร์ ฯลฯ งานนาฏกรรม เช่น ท่ารำ ท่าเต้น ฯลฯงานศิลปกรรม เช่น จิตรกรรม ประติมากรรม ภาพพิมพ์ ภาพถ่าย ศิลปประยุกต์ ฯลฯงานดนตรีกรรม เช่น ทำนอง ทำนองและเนื้อร้อง ฯลฯงานสิ่งบันทึกเสียง เช่น ซีดี งานโสตทัศนวัสดุ เช่น วีซีดี ดีวีดี ที่มีภาพหรือมีทั้งภาพและเสียงงานภาพยนตร์ งานแพร่เสียงแพร่ภาพงานอื่นใดในแผนกวรรณคดี วิทยาศาสตร์ หรือศิลปะ
ทั้งนี้ โดยทั่ว ๆ ไป อายุการคุ้มครองงานลิขสิทธิ์ (พระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537) จะมีผลเกิดขึ้นโดยทันทีที่มีการสร้างสรรค์ผลงาน โดยหลักการแล้วจะยึดมาตรา 19 เป็นหลัก ซึ่งกำหนดให้มีการคุ้มครอง 50 ปี หลังจากที่ผู้สร้างสรรค์เสียชีวิตแล้ว

2. ทรัพย์สินทางอุตสาหกรรม (Industrial Property) ตามกรมทรัพย์สินทางปัญญา หมายถึง ความคิดสร้างสรรค์ของมนุษย์ที่เกี่ยวกับสินค้าอุตสาหกรรมต่าง ๆ ความคิดสร้างสรรค์นี้อาจเป็นความคิดในการประดิษฐ์คิดค้น ซึ่งอาจจะเป็นกระบวนการหรือเทคนิคในการผลิต ที่ได้ปรับปรุงหรือคิดค้นขึ้นใหม่ หรือการออกแบบผลิตภัณฑ์อุตสาหกรรมที่เป็นองค์ประกอบและรูปร่างของตัวผลิตภัณฑ์ นอกจากนี้ ยังรวมถึงเครื่องหมายการค้า ความลับทางการค้า การคุ้มครองพันธุ์พืช แบบผังภูมิของวงจรรวม และสิ่งบ่งชี้ทางภูมิศาสตร์ เป็นต้น ซึ่งทรัพย์สินฯ แบ่งออกเป็น 6 ประเภท ที่ต้องรู้ ดังนี้
1. สิทธิบัตร (Patent) แบ่งความคุ้มครองใน 2 ลักษณะ คือ การคุ้มครองการคิดค้นสร้างสรรค์ที่เกี่ยวกับการประดิษฐ์ (Invention) และการคุ้มครองการออกแบบผลิตภัณฑ์ (Industrial Design) โดยสิทธิบัตรยังแบ่งออกเป็น 3 ประเภท ได้แก่
สิทธิบัตรการประดิษฐ์ (Invention Patent) (มาตรา 35) มีระยะเวลาคุ้มครองนานถึง 20 ปี นับจากวันที่ยื่นจดสิทธิบัตร และคุ้มครองในประเทศที่ยื่นจดเท่านั้น ทั้งนี้ หลักเกณฑ์ในการขอรับสิทธิบัตรการประดิษฐ์ จะต้องเป็นสิ่งประดิษฐ์ใหม่ มีขั้นการประดิษฐ์ที่สูงขึ้น และสามารถใช้ในอุตสาหกรรมได้
อนุสิทธิบัตร (Petty Patent) (มาตรา 65) ระยะเวลาคุ้มครองในส่วนกรรมวิธีมีอายุ 6 ปี นับจากวันที่ยื่นจด และคุ้มครองในประเทศที่ยื่นจดเท่านั้น ส่วนเจ้าของสิทธิสามารถยื่นต่ออายุได้ 2 ครั้ง ครั้งละ 2 ปี แต่ทั้งหมดนี้ไม่เกิน 10 ปี ซึ่งหลักเกณฑ์ในการขอรับอนุสิทธิบัตรไม่ซับซ้อนเท่าสิทธิบัตรการประดิษฐ์ แต่ยังคงต้องเป็นสิ่งประดิษฐ์ใหม่ และสามารถใช้ในอุตสาหกรรมได้
สิทธิบัตรการออกแบบผลิตภัณฑ์ (Design Patent) (มาตรา 62) มีระยะเวลาคุ้มครอง 10 ปี นับตั้งแต่วันที่ยื่นจด และได้รับการคุ้มครองในประเทศที่ยื่นจดเท่านั้น โดยคุ้มครองในส่วนรูปลักษณ์ ลวดลาย หรือสีสันของงานออกแบบผลิตภัณฑ์เท่านั้น แต่จะไม่ปกป้องในแง่ของการใช้งานหรือประโยชน์ใช้สอย ทั้งนี้ หลักเกณฑ์ในการขอรับสิทธิบัตรการออกแบบผลิตภัณฑ์ จะต้องเป็นสิ่งประดิษฐ์ใหม่ และสามารถนำมาใช้ในอุตสาหกรรมหรืองานหัตถกรรมได้
2. แบบผังภูมิของวงจรรวม (Layout-Design of Integrated Circuits) เป็นการคุ้มครองแบบผังภูมิของวงจรรวม มีอายุ 10 ปีนับแต่วันยื่นคําขอจดทะเบียน หรือนับแต่วันที่ นําแบบผังภูมินั้นออกใช้ประโยชน์ในเชิงพาณิชย์เป็นครั้งแรกไม่ว่าในประเทศไทยหรือในต่างประเทศ โดยถือวันที่เกิดขึ้นก่อน โดยการคุ้มครองจะมีอายุไม่เกิน 15 ปีนับแต่วันที่สร้างสรรค์แบบผังภูมินั้นเสร็จสิ้น (มาตรา 19)
3. เครื่องหมายการค้า (Trademark) ซึ่งเป็นเครื่องหมาย สัญลักษณ์ หรือตรา ที่ใช้กับสินค้าหรือบริการ ที่เรามักเรียกกันเองโดยทั่วไปว่า โลโก้ แบรนด์หรือยี่ห้อ ซึ่งประเภทของเครื่องหมายการค้า ได้แก่ เครื่องหมายการค้า (Trademark) เครื่องหมายบริการ (Service Mark) เครื่องหมายรับรอง (Certification Mark) และเครื่องหมายร่วม (Collective Mark) ผลแห่งการจดทะเบียนและอายุความคุ้มครอง (1) เจ้าของเครื่องหมายการค้าเป็นผู้มีสิทธิแต่เพียงผู้เดียวในการใช้เครื่องหมายการค้าของตน ในรายการสินค้าที่ได้จดทะเบียนไว้ โดยให้ถือว่าวันที่ยื่นคําขอจดทะเบียนเครื่องหมายการค้าเป็นวันที่จดทะเบียน เครื่องหมายการค้ารายนั้น (มาตรา 42 และมาตรา 44) (2) อายุความคุ้มครองเครื่องหมายการค้าให้มีอายุ 10 ปีนับแต่วันที่จดทะเบียน (มาตรา 53) (3) สามารถต่ออายุได้ภายใน 3 เดือนก่อนวันสิ้นอายุการจดทะเบียนหรือภายใน 6 เดือนนับแต่วันสิ้นอายุการจดทะเบียน โดยต้องชําระค่าธรรมเนียมเพิ่ม (มาตรา 54) ในกรณีที่เจ้าของเครื่องหมายการค้า มิได้ยื่นคําขอต่ออายุภายในกําหนดเวลา ให้ถือว่าเครื่องหมายการค้านั้นได้ถูกเพิกถอนการจดทะเบียนแล้ว (มาตรา 56)
4. ความลับทางการค้า (Trade Secret) เป็นข้อมูลธุรกิจที่ต้องการให้ปกปิดเป็นความลับในเชิงพาณิชย์ เมื่อเปิดเผยแล้ว ก็หมดอายุความคุ้มครอง เจ้าของความลับทางการค้านั้นโอนสิทธิในความลับทางการค้าให้แก่บุคคลอื่นได้ โดยการโอนซึ่งมิใช่ทางมรดกต้องทําเป็นหนังสือลงลายมือชื่อผู้โอนและผู้รับโอน และหากถ้าไม่ได้กําหนดระยะเวลาในสัญญาโอน ให้ถือว่าเป็นการโอนมีกําหนดระยะเวลา 10 ปี (มาตรา 5)
5. ชื่อทางการค้า (Tradename) ชื่อที่ตั้งขึ้นเพื่อประกอบธุรกิจการค้า เป็นชื่อเต็มขององค์กรธุรกิจ เช่น บริษัท ก. ไก่ จำกัด โดยชื่อทางการค้านี้จะเป็นสิ่งซึ่งแยกแยะเอกลักษณ์เฉพาะของแต่ละองค์กรออกจากกัน
6. สิ่งบ่งชี้ทางภูมิศาสตร์ (Geographical Indication) เป็นตัวบ่งบอกว่าสินค้านั้น ๆ เกิดจากแหล่งภูมิศาสตร์ใด เป็นสินค้าที่มีคุณภาพ ชื่อเสียง หรือคุณลักษณะเฉพาะของท้องถิ่น เช่น โรตีสายไหมอยุธยา มะม่วงเบาสงขลา ชามตราไก่ลำปาง เป็นต้น คําขอขึ้นทะเบียนสิ่งบ่งชี้ทางภูมิศาสตร์จะต้องประกอบด้วยรายละเอียดเกี่ยวกับคุณภาพ ชื่อเสียง หรือคุณลักษณะอื่นของสินค้า แหล่งภูมิศาสตร์ (มาตรา 10) และกรณีที่เป็นสิ่งบ่งชี้ทางภูมิศาสตร์ของต่างประเทศ ให้แสดงหลักฐานการได้รับความคุ้มครองตามกฎหมายของประเทศนั้นและหลักฐานการใช้มาจนถึงวันยื่นคําขอขึ้นทะเบียนในประเทศไทย (มาตรา 6)

Nowadays, the terms that we are familiar with and frequently mention include “copyright,” “patents,” “trademarks,” “trade secrets,” “trade names,” or are often collectively referred to as “copyright.” However, did you know that all of these are part of the category of “intellectual property,” which refers to works arising from the invention, creativity, and original invention stemming from our intellect, including even concepts?

Currently, the issue of intellectual property infringement continues to be an ongoing problem, both in the form of copyright infringement and counterfeit products or copy products. Especially when a product becomes successful and well-known, intellectual property infringement is undoubtedly bound to occur, which causes damage to businesses and affects the economic value of the country.

Do readers believe that each month and year, there are numerous cases of intellectual property infringement? The Department of Intellectual Property has revealed significant statistics on the crackdown on intellectual property infringement in Thailand, with a comparison of data between the years 2022 and 2023, from January to September, from the Royal Thai Police, the Department of Special Investigation, and the Customs Department, in both case and evidence forms, as shown in the table below.
Types of Intellectual Property
To protect innovations and mitigate the impact on businesses from infringing or being infringed upon by others’ intellectual property, business operators, entrepreneurs, or even startups must first understand how many types of intellectual property exist and what they protect. Here's a summary:
Intellectual property is divided into 2 categories:
1. Copyright (Copyright) refers to the exclusive right to perform any actions regarding works created by the creator using their intellect, knowledge, skills, and effort, without plagiarizing others' works. The works created must fall under the category protected by copyright law, and the creator is afforded protection immediately upon creation without the need for registration.
Works protected by copyright law comprise 9 categories as stipulated by the law, including:
Literary works such as books, pamphlets, publications, speeches, software, etc.; Dramatic works such as dance routines, movements, etc.; Artistic works such as paintings, sculptures, prints, photographs, applied art, etc.; Musical works such as melodies and lyrics, etc.; Audio recordings such as CDs; Audiovisual materials such as VCDs, DVDs containing images or both images and sounds; Cinematic works; Broadcasting works of any kind in the fields of literature, science, or arts.
Generally, the duration of copyright protection (Copyright Act B.E. 2537) takes effect immediately upon the creation of the work. In principle, it adheres to Section 19, which stipulates a 50-year protection period after the creator's death.

2. Industrial Property as per the Department of Intellectual Property, refers to human creativity related to various industrial products. This creativity may involve inventions, which can be processes or techniques for production that have been improved or newly invented, or the design of industrial products as representative features and shapes of the products. Additionally, it includes trademarks, trade secrets, plant variety protection, layout designs of integrated circuits, and geographical indications, among others. Industrial property is divided into 6 types that need to be known as follows:
1. Patent provides two types of protection: protection for creative inventions concerning inventions (Invention) and protection for industrial design (Industrial Design). Patents are further subdivided into 3 categories:
Invention Patent (Section 35) has a protection period of up to 20 years from the date of filing the patent application and is protected only in the country where the application is filed. The criteria for obtaining an invention patent must involve a novel invention, demonstrate a higher level of inventive step, and be industrially applicable.
Petty Patent (Section 65) has a protection period of 6 years from the filing date and is protected only in the country where the application is made. The right holder can renew this for 2 additional terms of 2 years each but not exceeding a total of 10 years. The criteria for obtaining a petty patent are less stringent than those for an invention patent but must still involve a novel invention and be industrially applicable.
Design Patent (Section 62) has a protection period of 10 years from the filing date and is protected only in the country where the application is made. This protects only the appearance, design, or colors of the industrial design and does not cover usage or utilitarian benefits. The criteria for obtaining a design patent must also involve a novel invention and must be applicable in industry or craftsmanship.
2. Layout-Design of Integrated Circuits provides protection for the layout design of integrated circuits for a period of 10 years from the date of filing the application or from the date of the first commercial utilization, whether in Thailand or abroad, using the earlier date. The protection shall not exceed 15 years from the date of completion of the creation of the layout design (Section 19).
3. Trademark is a sign, symbol, or mark used with goods or services, commonly referred to as a logo, brand, or trademark. Types of trademarks include Trademark, Service Mark, Certification Mark, and Collective Mark. The consequences of registration and the duration of protection (1) The trademark owner has the exclusive right to use their trademark on the registered goods. The date of application for trademark registration is considered the date of registration of that trademark (Sections 42 and 44). (2) The duration of trademark protection is 10 years from the date of registration (Section 53). (3) It can be renewed within 3 months before the expiration date or within 6 months after the expiration date, with an additional fee (Section 54). If the trademark owner fails to apply for renewal within the stipulated time, the trademark shall be deemed revoked (Section 56).
4. Trade Secret is business information intended to be kept confidential from commercial disclosure. Once disclosed, the protection period ceases. The owner of the trade secret can transfer their rights in the trade secret to another party; such transfer, unless otherwise stipulated, must be in written form signed by both the transferor and transferee. If a term is not defined in the transfer agreement, it is deemed to have a duration of 10 years (Section 5).
5. Tradename is the name established for business activities, serving as the full name of the business organization, such as Company A Ltd. This tradename is what differentiates the unique identity of each organization.
6. Geographical Indication indicates from which geographical source a product originates, representing goods known for quality, reputation, or specific characteristics of the locale, such as Ayutthaya cotton candy roti, Songkhla mango, or Lampang rooster brand bowls, etc. Applications for geographical indications must include details about the quality, reputation, or other characteristics of the product, and the geographical source (Section 10). In cases involving foreign geographical indications, evidence of legal protection in the country of origin and proof of use until the application date in Thailand must be presented (Section 6).
